The Autonomous Women's Center welcomes the decision of the Ministry of Justice to respond to the appeals of a large number of organizations and citizens and to prescribe a new criminal offense in the Criminal Code, Unauthorized sharing and abuse of a video of intimate content.
We remind the Ministry of Justice that citizens of Serbia should receive protection from all forms of abuse and sharing of photos and recordings of intimate content, in such a way that the following will be punishable:
- sharing content (photos, recordings, audio recordings or other files of intimate content) without the consent of the person on them,
- creating and sharing fake content with a third party in any way (showing, handing over) or modifying existing content using a computer or other information technology program,
- threats that such content will be shared in any way with third parties.
It is also necessary to introduce responsibility for the person who, as the organizer, enables sharing, handing over or showing content, regardless of whether that person shared or did not share such content. We propose that the prosecution of this new criminal act would be conducted based on motion of the victim/injured party, while aggravating forms to be prosecuted ex officio.
We hope that the Ministry of Justice will carefully consider and adopt one of the proposals that the Autonomous Women's Center, as well as at least 50 organizations and citizens, submitted during the public debate. We remind that the petition for the introduction of a new criminal offense conducted during campaign "Pledge on the Law" has been signed by more than 21,800 people since March 2024!
